{"id":2752,"date":"2022-12-27T17:51:40","date_gmt":"2022-12-27T16:51:40","guid":{"rendered":"https:\/\/www.sion-avocat.fr\/conciliation-in-the-interests-of-a-food-service-establishment\/"},"modified":"2026-04-04T13:11:26","modified_gmt":"2026-04-04T11:11:26","slug":"conciliation-in-the-interests-of-a-food-service-establishment","status":"publish","type":"post","link":"https:\/\/www.sion-avocat.fr\/en\/conciliation-in-the-interests-of-a-food-service-establishment\/","title":{"rendered":"Business Case &#8211; Conciliation in the interests of a food service establishment"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">A restaurant business weakened by the health crisis<\/h2>\n\n<p class=\"wp-block-paragraph\">For nearly a year, our client\u2014a well-known restaurant company in Marseille\u2014has suffered very substantial revenue losses due to COVID-19 and the various restrictions introduced by the government (notably the health pass).<\/p>\n\n<p class=\"wp-block-paragraph\">For almost a year, the restaurant attempted to negotiate amicably an outstanding rent debt of \u20ac60,000 with its landlord. The landlord requested an immediate payment of \u20ac25,000, with the remaining balance to be repaid according to a one-year schedule.<\/p>\n\n<p class=\"wp-block-paragraph\">As no agreement could be reached and considering the potential consequences for the company \u2014 including the risk of <a href=\"https:\/\/www.sion-avocat.fr\/en\/our-expertise\/companies-in-financial-distress\/judicial-reorganization\/\">judicial reorganization<\/a> or even liquidation \u2014 the management decided to instruct Ya\u00ebl Sion LAWYERS &amp; ASSOCIATES.<\/p>\n\n<p class=\"wp-block-paragraph\"><p data-start=\"888\" data-end=\"1002\">After a detailed discussion with the company\u2019s accountant, we recommended opting for a <strong data-start=\"975\" data-end=\"1001\">conciliation procedure<\/strong>.<\/p><\/p>\n\n<h2 class=\"wp-block-heading\">Why choose conciliation rather than an ad hoc mandate<\/h2>\n\n<p class=\"wp-block-paragraph\"><p data-start=\"1067\" data-end=\"1187\">The question could legitimately arise: why not choose an <a href=\"https:\/\/www.sion-avocat.fr\/en\/our-expertise\/companies-in-financial-distress\/mandat-ad-hoc-conciliation\/\"><strong data-start=\"1124\" data-end=\"1142\">ad hoc mandate<\/strong><\/a>, a procedure often considered more flexible?<\/p><br\/><p data-start=\"1189\" data-end=\"1427\"><\/p><\/p>\n\n<p class=\"wp-block-paragraph\"><p data-start=\"1189\" data-end=\"1427\">In this case, our objective was to restore the company\u2019s financial situation in a sustainable manner. This required, in particular, renegotiating the <strong data-start=\"1339\" data-end=\"1370\">State-Guaranteed Loan (PGE)<\/strong> in order to obtain a temporary suspension of repayments.<\/p><\/p>\n\n<p class=\"wp-block-paragraph\">The strategy therefore consisted of requesting a two-year suspension of the loan from the bank, followed by a rescheduling over six years.
