The administration considered that an accounting entry amounting to several thousand euros recorded in the company\u2019s accounts was insufficiently justified and therefore had to be reintegrated into the taxable income.<\/p><\/p>\n\n<p>According to the tax authorities, this accounting entry was not supported by sufficient evidence demonstrating its economic reality and accounting regularity.<\/p>\n\n<p><p data-start=\"731\" data-end=\"915\">The company, however, maintained that this entry was <strong data-start=\"784\" data-end=\"823\">fully lawful and properly justified<\/strong>, but that the documents provided had not been correctly assessed by the tax administration.<\/p><\/p>\n\n<h2 class=\"wp-block-heading\">An attempt to resolve the dispute amicably with the tax authorities<\/h2>\n\n<p><p data-start=\"994\" data-end=\"1134\">Initially, the company and its <strong data-start=\"1025\" data-end=\"1039\">accountant<\/strong> engaged in discussions with the tax authorities in an attempt to resolve the dispute amicably.<\/p><\/p>\n\n<p>The objective was to demonstrate the consistency of the disputed accounting entry and to provide the necessary documentation to justify its validity.<\/p>\n\n<p>Despite these exchanges and the explanations provided, the tax administration maintained its position and confirmed the proposed reassessment.<\/p>\n\n<h2 class=\"wp-block-heading\">Referral to the administrative court<\/h2>\n\n<p><p data-start=\"1477\" data-end=\"1612\">Following the failure of the amicable phase, the company decided to <strong data-start=\"1545\" data-end=\"1611\">challenge the tax reassessment before the administrative court<\/strong>.<\/p><\/p>\n\n<p>The litigation procedure made it possible to open a genuine legal debate on the elements of the case, both regarding the justification of the accounting entry and the conditions under which the reassessment procedure had been conducted.<\/p>\n\n<p><p data-start=\"1852\" data-end=\"2020\">In this type of dispute, a detailed legal analysis of the case, by a <a href=\"https:\/\/www.sion-avocat.fr\/en\/our-expertise\/tax-customs-law\/tax-reassessment\/\">tax reassessment lawyer<\/a>, is essential in order to identify the most relevant arguments to present before the administrative court.<\/p><\/p>\n\n<h2 class=\"wp-block-heading\">A defence based on procedural flaws and accounting justification<\/h2>\n\n<p>The defence strategy relied on two main approaches.<\/p>\n\n<p><p data-start=\"2149\" data-end=\"2359\">First, the analysis of the <strong data-start=\"2176\" data-end=\"2211\">regularity of the tax procedure<\/strong>, particularly to identify potential <strong data-start=\"2248\" data-end=\"2268\">procedural flaws<\/strong> in the conduct of the audit and in the procedural acts carried out by the tax authorities.<\/p><br\/><p data-start=\"2361\" data-end=\"2516\"><\/p><\/p>\n\n<p><p data-start=\"2361\" data-end=\"2516\">Second, the demonstration of the <strong data-start=\"2394\" data-end=\"2439\">validity of the disputed accounting entry<\/strong>, based on the accounting and economic documentation provided by the company.<\/p><br\/><p data-start=\"2518\" data-end=\"2699\" data-is-last-node=\"\" data-is-only-node=\"\"><\/p><\/p>\n\n<p>This legal and technical work makes it possible to bring the debate back to the legal ground and to demonstrate, where appropriate, that the contested tax reassessment is unfounded.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A tax reassessment based on a disputed accounting entry In this case, a company was subject to a tax reassessment following an audit conducted by the tax authorities.
