{"id":1185,"date":"2021-09-09T17:50:28","date_gmt":"2021-09-09T15:50:28","guid":{"rendered":"https:\/\/www.sion-avocat.fr\/case-on-administrative-closure\/"},"modified":"2026-04-02T15:00:09","modified_gmt":"2026-04-02T13:00:09","slug":"case-on-administrative-closure","status":"publish","type":"post","link":"https:\/\/www.sion-avocat.fr\/en\/case-on-administrative-closure\/","title":{"rendered":"Administrative closure case: defending a medical biology laboratory"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">A threat of administrative closure by the Regional Health Agency<\/h2>\n\n<p><p data-start=\"250\" data-end=\"444\">In this case, our client, a <strong data-start=\"278\" data-end=\"308\">medical biology laboratory<\/strong>, received a formal notice from the Regional Health Agency (ARS) announcing a potential <strong data-start=\"396\" data-end=\"422\">administrative closure<\/strong> of its establishment.<\/p><\/p>\n\n<p>This decision represented a major risk for the company, which employed several staff members and whose activity could have been interrupted immediately.<\/p>\n\n<p>Faced with this situation, Cabinet Sion Avocat was instructed to organise the defence of the laboratory and challenge the legality of the measure contemplated by the administration.<\/p>\n\n<h2 class=\"wp-block-heading\">An initial legal strategy before the administrative court<\/h2>\n\n<p><p data-start=\"850\" data-end=\"990\">As a first step, several legal actions were initiated before the <strong data-start=\"915\" data-end=\"939\">administrative court<\/strong> in order to challenge the administrative decision.<\/p><br\/><p data-start=\"992\" data-end=\"1163\"><\/p><\/p>\n\n<p><p data-start=\"992\" data-end=\"1163\">A <strong data-start=\"994\" data-end=\"1046\">summary suspension procedure (r\u00e9f\u00e9r\u00e9-suspension)<\/strong> as well as a <strong data-start=\"1060\" data-end=\"1087\">\u201cr\u00e9f\u00e9r\u00e9 mesures utiles\u201d<\/strong> were filed to seek the suspension of the effects of the contested decision.<\/p><br\/><p data-start=\"1165\" data-end=\"1498\"><\/p><\/p>\n\n<p><p data-start=\"1165\" data-end=\"1498\">At the same time, a <strong data-start=\"1185\" data-end=\"1214\">full action for annulment<\/strong> of the administrative decision was brought before the court. A <strong data-start=\"1278\" data-end=\"1326\">Priority Question of Constitutionality (QPC)<\/strong> was also raised before the administrative court in order to challenge the legality of certain provisions arising from the health reform on which the administration relied.<\/p><br\/><p data-start=\"1500\" data-end=\"1772\"><\/p><\/p>\n\n<p><p data-start=\"1500\" data-end=\"1772\">However, the administrative court rejected the summary proceedings on the grounds that the letter sent by the ARS was <strong data-start=\"1618\" data-end=\"1640\">merely informative<\/strong> and did not require the company to cease its activity. As a result, the court considered that the condition of urgency was not met.<\/p><\/p>\n\n<h2 class=\"wp-block-heading\">A new formal notice requiring the immediate cessation of activity<\/h2>\n\n<p><p data-start=\"1849\" data-end=\"1983\">Several weeks later, the situation evolved when our client received <strong data-start=\"1917\" data-end=\"1952\">a new notification from the ARS<\/strong>, this time much more explicit.<\/p><br\/><p data-start=\"1985\" data-end=\"2074\"><\/p><\/p>\n\n<p><p data-start=\"1985\" data-end=\"2074\">The administration formally ordered the laboratory to <strong data-start=\"2039\" data-end=\"2073\">immediately cease its activity<\/strong>.<\/p><br\/><p data-start=\"2076\" data-end=\"2180\"><\/p><\/p>\n\n<p>This decision directly threatened the continuity of the business as well as the employment of its staff.<\/p>\n\n<h2 class=\"wp-block-heading\">Proceedings before the Council of State<\/h2>\n\n<p><p data-start=\"2231\" data-end=\"2404\">In this context, a new phase of litigation began before the <strong data-start=\"2291\" data-end=\"2311\">Council of State<\/strong>, following summary proceedings initiated by the Minister of Health concerning this decision.<\/p><br\/><p data-start=\"2406\" data-end=\"2587\"><\/p><\/p>\n\n<p><p data-start=\"2406\" data-end=\"2587\">Ma\u00eetre Sion organised the defence of the laboratory before the highest administrative court, filing submissions through a <strong data-start=\"2528\" data-end=\"2586\">lawyer authorised to plead before the Council of State<\/strong>.<\/p><br\/><p data-start=\"2589\" data-end=\"2696\"><\/p><\/p>\n\n<p><p data-start=\"2589\" data-end=\"2696\">At the conclusion of these proceedings, the <strong data-start=\"2633\" data-end=\"2695\">Council of State issued a decision in favour of our client<\/strong>.<\/p><\/p>\n\n<h2 class=\"wp-block-heading\">The annulment of the administrative closure decision<\/h2>\n\n<p><p data-start=\"2760\" data-end=\"2978\">Despite this decision, the ARS resumed the procedure by sending <strong data-start=\"2824\" data-end=\"2847\">a new formal notice<\/strong>, delivered by registered letter with acknowledgement of receipt, again requiring the laboratory to immediately cease its activity.<\/p><\/p>\n\n<p>In response to this new attempt at administrative closure, several legal actions were initiated:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><p data-start=\"3080\" data-end=\"3125\">an <strong data-start=\"3083\" data-end=\"3122\">urgent summary suspension procedure<\/strong>,<\/p><\/li>\n\n\n\n<li><p data-start=\"3128\" data-end=\"3164\">a new <strong data-start=\"3134\" data-end=\"3161\">\u201cr\u00e9f\u00e9r\u00e9 mesures utiles\u201d<\/strong><\/p><\/li>\n\n\n\n<li><p data-start=\"3167\" data-end=\"3231\">an <strong data-start=\"3170\" data-end=\"3194\">action for annulment<\/strong> against the administrative decision.<\/p><\/li>\n<\/ul>\n\n<p><p data-start=\"3233\" data-end=\"3342\">At the end of these proceedings, the <strong data-start=\"3270\" data-end=\"3341\">administrative closure decision against the laboratory was annulled<\/strong>.<\/p><br\/><p data-start=\"3344\" data-end=\"3471\" data-is-last-node=\"\" data-is-only-node=\"\"><\/p><\/p>\n\n<p><div class=\"flex flex-col text-sm
